Her Upstairs Neighbors Won’t Stop Making Noise—Now She’s at Her Wits’ End

It’s one thing to make all kinds of racket and then own up to it and apologize for your behavior.

But it’s quite another to make a ton of noise and then fervently deny that you’ve done anything wrong.

Ugh!

What kind of person acts that way?

Well, the folks in this story, apparently…

And I gotta say, if I was in this woman’s situation, I’d be losing my cool, too.

Check out the rude neighbors she’s dealing with on a daily basis.

Upstairs Neighbor With Loud Kids Denying Any Wrongdoing.

“Last night, I finally worked up the nerve to confront my upstairs neighbor with a few (not as young as you would expect) children about the noise level.

How annoying!

I mentioned not only the constant banging / dropping what sounds like bowling balls on the floor but also a couple nights ago there was vacuuming at 11 PM and banging until 2 AM.

I will admit that I haven’t been a saint and I have made retaliatory noises by hitting the ceiling with a broomstick before. She immediately mentioned this and I owned up to it, but the problem is she did not acknowledge the time-stamped incidents I had just brought up.

Ugh…

She said, “we are just living our lives.”

Our lease has two sections about a right to a quiet environment:

Tenant must not do any of the following, or allow someone else to do any of the following:

“Harass, annoy, or endanger any other tenant or neighbor, or their guests, or create any excessive noise or public nuisance.

QUIET ENJOYMENT: Tenant shall be entitled to the quiet enjoyment of the premises during the term of this lease, as long as Tenant complies with the terms of this lease. Tenant shall make every effort to keep all noise to a minimum between the hours of 9 PM and 8 AM.

Landlord may terminate this lease if Lessee or Lessee’s guest is cause of excessive noise complaints on three or more occasions during the term of this lease, and/or, three or more times. Termination of this lease does not relieve Lessee of financial obligations under the lease.”

I am not asking anyone to tell me I was right about the ceiling banging (which is nowhere near as common as upstairs banging).

I know in hindsight that was a detriment to my case. I managed to get the noise level to drop for exactly one evening and it’s back to being the usual.

Now what…?

I am dreading entering a “Cold War” situation with them by escalating it to management but I really cannot live like this.

It’s awful.”
