Their Downstairs Neighbors Couldn’t Sleep for Months—Until They Logged Decibel Spikes and Served a Statutory Quiet Enjoyment Demand

Imagine living in an apartment where the family that lives above you is extremely loud even late at night. Would you learn to live with it or try to find a way to get them to keep it down?
In this story, one family is in this situation. Their upstairs neighbors have been extremely noisy ever since they moved in. The landlord hasn’t been helpful, and it sounds like the police may not be helpful either.
What should they do?

Where do you turn when your landlord is no help?
I live in an apartment with 2 units. My family and I live on the first floor and we have new neighbors that moved in February 1st. A mother and her 2 children ages 14 and 11.
The whole month and a half they’ve lived here they’ve been nothing but trouble.
The problems actually started before the neighbors moved in.
About a week before they moved into the apartment the mom throw a birthday party in the unit for one of her kids. They were given the keys so they had access to the apartment.
They invited several guests and made a complete nuisance from about 6:00pm until after 1:00am.
They were running and stomping around screaming and yelling, loud thumping and banging on the floor.
They were literally shaking the house!
She decided to talk to the neighbor.
So I went upstairs after about 2 hours or so of listening to all the noise and asked if they could kindly bring the noise to a reasonable level.
The mom was very rude and snapped at me saying “I’m having a birthday party for my son and we have a right to do what we want until 10:00pm.
So there was no change in the noise at all.
So at 10:00 the noise still continued at the same level.
She tried to talk to the neighbor again.
I went upstairs again to remind my neighbor that the noise ordinance in our town takes affect at 10:00pm and they need to quiet down.
This time she says “I have guests here so if you don’t like it call the landlord”.
So I did just that. I called my landlord and she said she would call my neighbor and tell them they need to be quiet.
But the noise just continued until after 1:00am.
The noise has continued ever since.
We have continually had numerous issues with noise from our neighbors.
We often call the landlord and she tells us that she spoke to the neighbor and there’s nothing more she can do about it.
The neighbor also lies about the noise saying that they aren’t making any noise and they’re just getting around normally.
This of course is a complete lie. Her kids are always running and stomping and yelling through the apartment everyday!
She’s not sure what to do.
So my question is what other recourse can I take other than talking to my landlord?
The landlord is taking no real action to rectify the noise issues.
I have yet to call the police. I also feel like the police won’t do anything.

I have called just to get information about the noise ordinance in my town. But the police also told me that they normally don’t handle noise complaints and that I would have to take it up in housing court.
I don’t have the money to go to court over this
.Is there anything else effective that anyone has done to rectify noise complaiother than moving?
I was going to suggest calling the non-emergency police line. That’s what I’ve done in the past when neighbors are way too loud at night, and it does make a difference. However, it sounds like that won’t work for her.

Here’s some more advice.
If the landlord won’t help, the police won’t help, and the neighbor refuses to care, they have to make the neighbor care. I like the idea of being equally loud back to try to encourage the neighbor to knock it off. I also like the idea of being loud in the morning to get the point across.
Noisy neighbors are the worst!
